8. GLBA and insurance privacy
For customers who obtain insurance primarily for personal, family, or household purposes, we treat nonpublic personal information (NPI) consistent with the Gramm Leach Bliley Act and applicable state insurance privacy laws. We provide NPI to non affiliates only as permitted by law, such as to service your policy, process claims, prevent fraud, or as required by regulators. We provide annual privacy notices where required. No action is needed to opt out of marketing affiliate sharing because we do not engage in such programs.
Tax return confidentiality and preparer consents (IRC §7216 and §6713)
We are not a tax return preparer. When a tax professional shares a client’s tax return information with us, they must have the taxpayer’s written consent that satisfies 26 CFR §301.7216 3. These rules restrict a preparer’s disclosure or use of “tax return information” and impose criminal penalties under 26 U.S.C. §7216 and civil penalties under 26 U.S.C. §6713 for unauthorized disclosure or use. We require preparers to obtain and document a valid consent naming InsureTax, describing the purpose (for example underwriting, policy servicing, or claims), and signed and dated by the taxpayer. We use return information only for the permitted purpose and we prohibit re disclosure except to carriers, reinsurers, administrators, service providers, or regulators as needed to provide insurance or comply with law.
IRS held return information (IRC §6103). 26 U.S.C. §6103 governs confidentiality of returns and return information held by the IRS. It generally restricts IRS disclosures, with limited exceptions such as taxpayer consent under §6103(c). We typically receive filings from you or your preparer, not from the IRS. If you authorize us or our vendors to obtain IRS transcripts directly, we will follow §6103(c) consent requirements and any associated redisclosure limits.
9. Children’s information
Our services are intended for adults and business users. We do not knowingly collect personal information from children under 16.
10. Data retention
We retain personal information for as long as needed for the purposes described, including: policy and claim life cycles, audits, regulatory retention, tax and accounting, and fraud prevention. Insurance and financial records are typically retained 7 to 10 years after the policy or claim closes, unless a longer period is required by law or necessary to establish, exercise, or defend legal claims.
11. Data security
We use administrative, technical, and physical safeguards appropriate to the nature of the information, including access controls, encryption in transit and at rest where feasible, network monitoring, and personnel training. No method of transmission or storage is perfectly secure. If we become aware of a breach affecting your information, we will notify you and regulators as required by law.
12. International data transfers
We are headquartered in the United States and may process information in the United States and other countries, including Israel and the United Kingdom. If you are in the EEA or UK, we rely on appropriate safeguards for transfers, such as Standard Contractual Clauses and equivalent UK addenda where applicable.
